§ 1 Contractual Partner
The contract is made with ABC Games UG (limited liability), Mozartstraße 3a, 83435 Bad Reichenhall, Commercial Register: Traunstein District Court, HRB 34054 (hereinafter referred to as "SightSolve" or "ABC Games UG").

§ 2 Offer and Conclusion of Contract

SightSolve provides products and services that enable customers to independently conduct sightseeing and crime‑themed tours (see §3 for scope of services).The presentation of materials in the online shop does not constitute a legally binding offer but is only an invitation to place an order. By clicking the order button, you submit a binding order for the materials. The contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

§ 3 Scope and Content of Services

The scope of the contractual services is determined by the information provided in the order confirmation.
The service includes, within the scope specified in the order confirmation, the provision of materials to independently conduct the sightseeing tour. The customer can choose between picking up the materials at a partner store or having them shipped.
a. After placing the order, the order confirmation will be sent via email.
b. In the case of pickup, the email will contain a voucher for collection at a partner store.
c. In the case of online shipping, the materials will be sent in a separate email.
The service does not include:
a. the fulfillment of the purpose of the tour,
b. supervision of the tour, especially for children, adolescents, and persons in need of assistance,
c. supervision of items that the customer or their companions have with them during the tour,
d. payment of any road tolls or parking fees,
e. payment of travel or accommodation costs,
f. payment for food or beverages,
g. payment for personal equipment (e.g., umbrella, appropriate clothing, etc.) necessary for conducting the tour.
This clause does not apply if otherwise expressly agreed upon in writing.

§3.1 Bookings via SightSolve Platform/Webapp (self-guided tours; not e-commerce store)

a. Bookings for self-guided tours made via SightSolve’s online platforms and mobile app (“SightSolve Platforms”) are completed when the booking confirmation is displayed on the Platform and sent by email.

b. For such bookings, the selected payment method may be authorised at the time of booking and is only charged (captured) once the booking has been successfully confirmed.

c. Once a booking has been completed and the booking confirmation has been sent, the booking is binding and the ticket price is non‑refundable. The customer has no right to cancel the booking or to a refund of the ticket price unless SightSolve cancels the tour.

d. If SightSolve, in deviation from clause c, voluntarily agrees to refund a booking made via the SightSolve Platforms, any non‑recoverable transaction or refund fees charged by payment service providers to SightSolve will be deducted from the refund amount and borne by the customer

§ 4 Prices and Shipping Costs

The prices listed on the product pages include the statutory value-added tax and other price components.
In addition to the stated prices, we charge a flat shipping fee per order for deliveries within Germany. The shipping costs are clearly communicated to you in the shopping cart system and on the order page.

§ 5 Delivery

Delivery is only available within Germany via a shipping service provider selected by us, typically DHL.
The delivery time is usually up to 5 business days. As delivery depends on the shipping service provider, we cannot guarantee a specific delivery time.

§ 6 Pickup

A voucher included in the order confirmation is required for pickup.
The pickup locations and their business hours are specified in the order confirmation.

§ 7 Payment

Payment is made exclusively through the options displayed in the shopping cart system.

§ 8 Behavior of the Customer and Companions

The customer is responsible for independently conducting the tour.
The customer is responsible for the behavior of their companions during the tour:
a. No non-public buildings are entered during the tour.
b. No shops or stores are entered during the tour.

§ 9 Liability

SightSolve does not guarantee the tour's feasibility at all times and is not liable for route restrictions due to force majeure, events, demonstrations, construction sites, or other factors. Any costs incurred due to the tour's infeasibility will not be reimbursed.
SightSolve is not liable for injuries to life, body, health, or property damages that may occur during the tour.
SightSolve is not liable for the availability of partner stores, e.g., opening hours.
SightSolve is not liable for any misconduct by the customer or their companions before, during, or after the tour. The customer is solely responsible for ensuring the smooth execution of the tour.

§ 10 Copyright

SightSolve is a registered trademark of ABC Games UG.
SightSolve holds all copyright to the sightseeing tour it created and the associated web and print pages. Resale, even in modified form, requires the express consent of ABC Games UG. Distribution of the materials is not permitted. The images and texts used in the materials may not be used for other purposes.

§ 11 Data Protection

To fulfill the contract, personal data is stored in accordance with data protection laws, and the transfer of such data to third parties for advertising purposes is excluded. The necessary data for processing the contract may be shared with third parties involved in fulfilling the contract.
The customer generally agrees to the storage of their personal data to allow for future contact regarding other SightSolve products.

§ 12 Final Provisions

The place of jurisdiction is Munich. The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If any provision of these terms and conditions is or becomes invalid, the remaining provisions shall remain unaffected.
